ChatGPT and Reddit under the EU's strictest rules

What's this about?

Both services have been designated under the EU's toughest online safety tier, bringing the strictest set of obligations.

What does the designation actually require?

Under the Digital Services Act, platforms above a user threshold get an additional regime: annual independent audits, systemic risk assessments covering things like illegal content and effects on fundamental rights, data access for vetted researchers, transparency on recommendation and advertising systems, and direct Commission supervision with revenue-percentage fines. The researcher access and advertising transparency provisions are the ones with teeth for a chat assistant.

Why is it worth noticing?

HN 5 points — almost no discussion
  1. It lands the same day as the ChatGPT Ads expansion into Europe, and the advertising transparency obligations apply to exactly that.
  2. Designating a conversational assistant under a regime written for social platforms is a genuinely novel legal question.
  3. Very low engagement for something with real regulatory consequences, which is worth noting on its own.
